This Agreement is entered into between RecoveryNow, owned and operated by Stefan Muraru, and the registered Service Provider ("You").
By registering and providing services via RecoveryNow, you agree to the following terms:
1. Independent Contractor Status
You operate as an independent contractor, not as an employee, agent, or partner of RecoveryNow. You are responsible for your own taxes, insurance, and legal obligations.
2. Licensing & Compliance
You agree to maintain valid licensing, certification, and insurance required for roadside assistance or automotive services under Irish law. RecoveryNow may request proof at any time.
3. Service Standards
You agree to provide professional, lawful, and safe service to all Customers. Misconduct, overcharging, or unprofessional behaviour may result in suspension or removal.
4. Payments
Payments for completed services will be processed through Stripe Connect. RecoveryNow retains a 10% commission on completed transactions.
Subscription fees (where applicable) are billed monthly:
- Recovery Drivers: €19.99/month (first 3 months free)
- Garages: €49.99/month (VAT included)
5. Liability
You acknowledge that you are solely responsible for your service performance, safety, and outcomes. RecoveryNow accepts no liability for damages or losses caused during or after your service.
6. Cancellations & Refunds
Cancellations must be communicated promptly. Repeated no-shows or unprofessional conduct may result in account suspension.
7. Data Protection
You must handle all customer information in compliance with GDPR and RecoveryNow's Privacy Policy.
8. Termination
RecoveryNow reserves the right to suspend or terminate your account at any time for breach of these terms or harmful conduct.
Insurance & Liability Requirements
To ensure safety and professionalism across the RecoveryNow platform, all registered Providers (Recovery Drivers and Garages) must comply with the following:
Insurance Coverage
- Hold valid motor trade insurance and public liability insurance covering recovery and towing services.
- Provide proof of insurance during onboarding and renewals.
Liability
- Providers are fully responsible for any damage, loss, or injury that occurs during the provision of services.
- RecoveryNow is not responsible for any acts, omissions, or damages caused by Providers.
- In the event of a dispute, Customers and Providers are expected to resolve issues directly, though RecoveryNow may assist in communication when possible.
Customer Vehicles
- Providers must take reasonable care to prevent damage to vehicles during recovery, towing, or repair.
- Any damage resulting from negligence is the sole responsibility of the Provider.
Vehicle Safety
Providers must use approved recovery equipment and ensure vehicles are secured safely during transport.
Indemnification
Providers agree to indemnify and hold harmless RecoveryNow, its founders, and affiliates against all claims, damages, or losses arising from the Provider's actions, negligence, or non-compliance.
